These Terms of Service (“Terms”) govern your use of Pollyngrey.store and any purchase you make through our website.

Throughout these Terms, the terms “Pollyngrey”, “we”, “us” and “our” refer to the trader operating Pollyngrey.store. The terms “you”, “your”, “customer” and “consumer” refer to the person accessing the website or purchasing products from us.

By using our website or placing an order, you agree to these Terms.

Nothing in these Terms excludes, limits or otherwise affects any statutory rights that you have as a consumer under applicable UK law.

If we cannot supply an item you have ordered, we will notify you as soon as reasonably possible and, where payment has already been taken, provide an appropriate refund.

We will not substitute a materially different product without your agreement.


6. PRICES

Product prices will be displayed on Pollyngrey.store before you place an order.

We aim to ensure that all prices are accurate.

The total amount payable, including any compulsory charges and applicable taxes that must legally be included or disclosed, will be shown before you complete your purchase.

Delivery charges, where applicable, will also be clearly displayed or calculated before you place the order.

We will not add optional charges without your express consent.


7. PRICING ERRORS

Despite our reasonable efforts, a product may occasionally be incorrectly priced.

If we discover an obvious pricing error before accepting your order, we may contact you and give you the option to purchase the product at the correct price or cancel the order.

We will not rely on this provision to make arbitrary price changes after a binding contract has been formed.

If an order is cancelled because of a genuine pricing error and payment has already been taken, the relevant payment will be refunded.

Your statutory rights remain unaffected.


8. PROMOTIONS AND DISCOUNTS

Promotional offers, discount codes and special campaigns may be subject to additional conditions displayed at the time of the promotion.

Unless expressly stated otherwise:

  • there is an obvious pricing or product-information error;

  • payment cannot be authorised;

  • the delivery address cannot reasonably be serviced;

  • we reasonably suspect fraudulent or unlawful activity;

  • the order appears to be for unauthorised resale or abuse of a promotion; or

  • accepting the order would breach applicable law.

Where we cancel an order after taking payment, we will provide any refund legally due.

We will not exercise this right arbitrarily or in a way that removes your statutory consumer protections.


12. PAYMENT

Available payment methods will be displayed during checkout.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

Payments may be processed by third-party payment service providers.

We may carry out reasonable payment verification and anti-fraud checks before dispatching an order.

We are not responsible for additional fees independently imposed by your bank, card issuer or payment provider where those charges are outside our control and were not charged by Pollyngrey.


13. DELIVERY

Available delivery options and applicable charges will be displayed during checkout or explained in our Shipping Policy.

Customers may be offered options including:

  • Standard Shipping; and

  • Express Shipping.

Applicable delivery estimates will be disclosed separately during the purchasing process or in our Shipping Policy.

We will deliver goods within the period agreed with you.

Where no specific period has been agreed, applicable UK statutory delivery requirements will apply.


14. DELIVERY ADDRESS

You are responsible for providing a complete and accurate delivery address.

Please review your delivery details carefully before placing your order.

We cannot guarantee that an address can be changed after an order has been processed or dispatched.

15. DELAYED DELIVERY

Where delivery by an agreed date is essential and the legal conditions are satisfied, you may have the right to terminate the contract.

In other circumstances, you may be entitled to require delivery within an appropriate additional period before cancelling.

Nothing in these Terms removes any statutory remedy relating to late or failed delivery.


16. RISK IN THE GOODS

For consumer orders, risk of loss or damage will pass to you in accordance with applicable consumer law.

Where we arrange delivery through a carrier, you will not generally bear the risk merely because we have handed the goods to that carrier.

This provision does not apply in the same way where you independently commission a carrier that was not offered by us.


17. OWNERSHIP OF GOODS

Ownership of goods normally passes to you when we have received full payment for the relevant products, subject to applicable law.

Risk and legal ownership are separate concepts and may pass at different times.


18. YOUR RIGHT TO CANCEL

Consumers purchasing online will normally have a statutory right to change their mind.

For most eligible goods, you may notify us that you wish to cancel within 14 days after the day on which you, or a person nominated by you, receives the goods.

You do not need to provide a reason for exercising the statutory cancellation right.

After notifying us, you normally have a further 14 days to return the goods.

19. EXCEPTIONS TO CANCELLATION RIGHTS

Certain products may be excluded from the statutory change-of-mind cancellation right where UK law permits.

  • products made to your specifications;

  • clearly personalised goods;

  • goods that deteriorate or expire rapidly;

  • certain sealed goods unsuitable for return for genuine health or hygiene reasons after the seal has been broken; and

20. RETURNS AND REFUNDS

Returns and refunds are governed by our Return & Refund Policy and applicable UK consumer law.

Where you validly cancel an eligible distance contract, we will provide the refund required by law.

Where applicable, this may include the least expensive standard delivery charge offered for the original order.

If you selected an enhanced or premium delivery service, any amount exceeding the standard delivery charge may not be refundable where the law permits.


21. RETURN COSTS

For a change-of-mind return, you will normally be responsible for the direct cost of returning the goods where this has been disclosed to you and the law permits.

Where goods are faulty, damaged, incorrect or otherwise non-conforming, Pollyngrey will bear reasonable return costs where required by law.

22. CONDITION OF CHANGE-OF-MIND RETURNS

You are entitled to inspect goods in a manner broadly comparable to what would reasonably be permitted in a physical shop.

If goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning, we may make an appropriate deduction for any resulting reduction in value where UK law permits.

This does not apply so as to restrict remedies for faulty or non-conforming products.


23. FAULTY OR NON-CONFORMING GOODS

Goods supplied by Pollyngrey must comply with applicable requirements under the Consumer Rights Act 2015.

Among other legal requirements, goods must generally be:

  • of satisfactory quality;

  • fit for applicable purposes; and

  • as described.

If an item does not meet applicable legal standards, you may have rights including, depending on the circumstances:

A discounted price does not remove your legal rights.

If an item was discounted specifically because of a defect that was clearly disclosed to you before purchase, you may not be able to claim that the disclosed defect makes the goods non-conforming.

Other statutory rights remain unaffected.

Mandatory pre-contract information provided to you in connection with your purchase also forms part of the consumer contract where required by law.


53. PRECEDENCE OF STATUTORY RIGHTS

If any statement contained in:

  • our Shipping Policy;

  • a promotional offer;

  • product information; or

  • another store policy

conflicts with a mandatory statutory consumer right, the statutory right will take precedence.
